App Terms and Conditions Australia
Please read these Terms and Conditions ("Terms") carefully before using the Tixserve Australia mobile ticketing application (the “App" or "Service"). These Terms, together with the Tixserve App Privacy Policy, govern your use of the App and set out the terms of your agreement with Tixserve (UK) Limited.
By downloading, installing, accessing or using the App, you acknowledge that you have read, understood and agree to be bound by these Terms and the Privacy Policy. If you do not agree to these Terms, you must not use the App.
1. Introduction and Scope
These Terms govern your use of the Tixserve mobile ticketing application. The App is provided by Tixserve (UK) Limited, a company registered in the United Kingdom.
1.1. Definitions. For the purposes of these Terms:
- "Tixserve", "we", "us" or "our" refers to Tixserve (UK) Limited.
- "You" or "user" refers to any individual who accesses or uses the App.
- "App" or "Service" refers to the Tixserve mobile ticketing application.
- "Privacy Policy" refers to the Tixserve App Privacy Policy, which is available within the App here.
1.2. App Purpose. The Tixserve App is provided exclusively for demonstration and sales purposes. It is intended to showcase the technology to prospective clients and other interested parties. The App is not intended for commercial or public use, and Tixserve makes no guarantees that tickets accessed via the App will be valid for entry to any event.
1.3. User Eligibility. You must be 16 years of age or older to use this App. By using the App, you represent and warrant that you are at least 16 years old.
2. Your Tixserve Account
To use the App, you must create a user account.
2.1. Account Registration. You agree to provide accurate, current and complete information during the registration process, including your full name, phone number, email address, and postal address. You are responsible for keeping this information up to date.
2.2. Account Security. You are solely responsible for maintaining the confidentiality of your account login details and for all activities that occur under your account. You must notify us immediately if you suspect any unauthorised use of your account.
2.3. Account Termination. We reserve the right to suspend or terminate your account at our sole discretion, without notice, if we believe you have violated these Terms. You may also delete your account at any time.
3. App License and Restrictions
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use, subject to these Terms.
3.1. Prohibited Actions. You agree not to:
- Use the App for any illegal or unauthorised purpose.
- Reverse-engineer, decompile or disassemble the App.
- Attempt to gain unauthorised access to the App's systems or data.
- Use any automated system, such as "bots" or "spiders," to access the App.
- Use the App to send unsolicited communications (spam).
4. Intellectual Property
All content and materials within the App, including text, graphics, logos and software, are the exclusive property of Tixserve and are protected by copyright, trademark and other intellectual property laws.
4.1. User-Generated Content. Any content that you create, upload, post or submit to the App ("User Content") remains your property. However, to enable the functionality of the App and to provide our Service, you grant Tixserve a worldwide, non-exclusive, royalty-free license to use, reproduce, process, modify and display your User Content as necessary. This license is strictly limited to the purpose of providing the App’s services. For example, when you provide recipient details for a ticket transfer, you grant us permission to process and display that information to facilitate the transfer. 5. Data Privacy and Australian Privacy Law
Your privacy is important to us. Our Privacy Policy, which is incorporated into these Terms by reference, explains how we collect, use and protect your personal information in compliance with Australia’s Privacy Act 1988 (Cth), including the Australian Privacy Principles (APPs).
5.1. Your Rights. Under the Privacy Act, you have several rights regarding your personal information, as detailed in our Privacy Policy. These include the right to access or correct your personal information and the right to make a complaint.
5.2. How We Use Your Information. We use your personal information only when it is reasonably necessary for our business functions and activities, as detailed in our Privacy Policy. This includes using your information to provide our core service, for fraud detection and to diagnose technical issues.
5.3. Third-Party Data Processors. As described in our Privacy Policy, we use third-party service providers who assist us in operating and maintaining the App. All such providers are bound by strict agreements that require them to adhere to data protection standards consistent with the Privacy Act and the Australian Privacy Principles.
5.4. Data Transfers. We may transfer your personal information outside of Australia, and by providing us with your personal information, you consent to this cross-border disclosure. We ensure that appropriate safeguards are in place to protect your information in accordance with Australian data protection laws.
6. Disclaimers and Limitation of Liability
6.1. Disclaimer of Warranties. The App is provided on an "as is" and "as available" basis. Tixserve is committed to providing a secure service and has implemented robust, industry-standard security measures. However, given the App's use for demonstration purposes, and the inherent risks of technology, and to the maximum extent permitted by law, Tixserve makes no express warranties or guarantees of any kind regarding the App's performance, functionality or security, beyond those implied by law (such as satisfactory quality and fitness for purpose for its demonstration use). Your use of the App is solely for demonstration purposes, and your continued use acknowledges this disclaimer.
6.2. Limitation of Liability. Nothing in these Terms excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law (ACL) or any other applicable law that cannot be lawfully excluded, restricted or modified. This includes, but is not limited to, guarantees relating to acceptable quality, fitness for any disclosed purpose, and matching description.
Subject to the foregoing, and to the maximum extent permitted by law, Tixserve shall not be liable for any indirect, incidental, special or consequential damages, including but not limited to any financial loss, loss of data or loss of profits, arising from your use of this App or any ticket contained within it. You acknowledge that your use of the App is solely for demonstration purposes and that no financial consideration has been paid for the App or any ticket within it. In any event, and subject to the mandatory provisions of law, our total liability to you for any and all claims arising from these Terms or the App shall be limited to direct damages only.
7. Ticket Transfers
The App allows you to transfer tickets to other users.
7.1. Consent for Contacts. When you use the ticket transfer feature, you may be prompted to grant the App temporary access to your device's contacts list. This data is used solely to help you select a recipient and is not stored on our servers.
8. Governing Law and Dispute Resolution
8.1. Governing Law. These Terms shall be governed by and construed in accordance with the laws of New South Wales, Australia.
8.2. Dispute Resolution. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
9. Miscellaneous Provisions
9.1. Entire Agreement. These Terms, along with the Privacy Policy, constitute the entire agreement between you and Tixserve regarding your use of the App.
9.2. Severability. If any provision of these Terms is deemed invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
9.3. Changes to Terms. We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms within the App and updating the "Last Updated" date. Your continued use of the App after such changes constitutes your acceptance of the new Terms.
